01–Policy background
In April 2026, the Eswatini Communications Commission (ESCCOM) issued General Notice No. 4/2026, announcing that from Monday, April 13, 2026, all electronic communication equipment imported into or used within Eswatini will be required to provide a Type Approval Certificate.
This measure not only strengthens the enforcement of the 2016 Electronic Communications (Importation of Communications Apparatus, Type Approval and Distribution) Regulations but also marks a key step in Eswatini’s proactive enforcement of its regulatory framework at ports of entry, with significant impact on companies planning to export electronic communication equipment to Eswatini.
02–Key points of the policy explained
Effective date:
April 13, 2026 — the hard compliance deadline
From Monday, April 13, 2026, all entities intending to import or use electronic communication equipment must first hold a valid Type Approval Certificate issued by ESCCOM. This is a hard deadline — there is no buffer period or exemption arrangement whatsoever.
1. Border enforcement mechanism:
ASYCUDAWorld system + joint ERS inspection
The most deterrent element of this policy lies in its border enforcement mechanism.
ESCCOM has signed a memorandum of cooperation with ERS, using ERS’s customs declaration management system ASYCUDAWorld (which operates under the Customs and Excise Act, 1971) to enforce compliance checks at the border.
2. The specific enforcement path is as follows:
- Automatic verification at import declaration: when importers file customs declarations through ASYCUDAWorld, the system will verify whether the declared goods carry valid type approval certificate information.
- Physical checks at ports: ERS customs officers will inspect and verify imported goods at every port of entry to confirm compliance.
- Non-compliant goods will be intercepted: equipment without a valid type approval certificate will be automatically flagged or seized by the system at the border and cannot complete customs clearance.
- Full coverage of all ports nationwide: the checks cover all entry ports across Eswatini (including land crossings and airports), leaving no enforcement blind spots.
As ESCCOM emphasized in its notice: “Communication equipment imported into Eswatini must complete type approval before it actually arrives at the border, rather than trying to remedy the situation at clearance.”
03–Scope of affected products

Notice No. 4/2026 covers “electronic communication equipment”, including radio equipment, telecom terminal equipment, and broadcasting terminal equipment, all of which must pass type approval or type acceptance before import and use, unless explicitly exempted by ESCCOM.
04-Consequences of violation: heavy fines + criminal liability
Importers and distributors must take this policy change seriously; the cost of non-compliance is severe.
According to an April 3, 2026 report by the Eswatini Independent, importers who violate the new rules face severe penalties:
- A fine of up to E20,000 (approximately RMB 8,000)
- Or two years’ imprisonment
In addition, unapproved equipment may be confiscated on the spot at customs. These penalties are based on the Communications Act of Eswatini, 2021 and related regulations, covering all acts of importing, selling, and using unapproved equipment.
